1. Agreement

These terms are an agreement between you and Blue Energy People, Inc. ("SUN", "we", "us") covering the SUN web app, the mobile app, and the Sun Public API. By creating an account or using the service you accept them. If you are agreeing on behalf of an organization, you confirm you have the authority to bind it.

2. What SUN does

SUN turns a prompt, or source material you supply, into an audio course: we generate a script, structure it into chapters, and narrate it in a synthetic voice. Output is produced by machine learning models. It is meant for learning and entertainment, and it is not a substitute for professional advice.

3. Your account

You need an account to generate courses, and you must be at least 13 years old to have one. Keep your credentials and any API tokens you create to yourself. Activity under your account is your responsibility. Tell us promptly if you think someone else has access.

4. Credits and plans

Generation consumes credits, and each account starts with an allowance. The plans page shows the credit packs we intend to offer; purchasing is not switched on yet, so no charges are possible today and every buy control is disabled.

When purchasing does open, credits will be a prepaid license to use the service rather than a stored-value instrument: they are not money, they carry no cash value, and they are not transferable between accounts. We will publish pricing and refund terms here before we take a payment from anyone.

5. Acceptable use

Do not use SUN to:

  • Generate content that is illegal, that sexualizes minors, or that incites violence or harassment.
  • Impersonate a real person or organization, or present generated audio as an authentic recording of someone.
  • Produce deliberate misinformation, or content designed to deceive people about who made it.
  • Upload material you do not have the rights to use, including copyrighted text or recordings.
  • Probe, scrape, overload, or reverse engineer the service, or work around quotas and rate limits.
  • Resell raw access to the generation pipeline as if it were your own API.

We may remove content or suspend accounts that break these rules, and we do not owe a refund of credits consumed in the process.

6. Your content

You keep ownership of the prompts, text, and recordings you bring to SUN. You grant us the license we need to run the service on them: to store them, send them to our model providers for processing, and produce and host the resulting course for you. That license exists to operate SUN and ends when you delete the content.

You are responsible for having the rights to whatever you submit, and for the content you choose to share publicly with a share link.

7. Voice cloning

You may only create a cloned voice from a recording of yourself, or of someone who has given you clear, informed permission for that specific purpose. Cloning a public figure, a celebrity, or anyone who has not consented is a violation of these terms, and we will remove the voice and may terminate the account.

Cloned voices are private to the account that created them. You can delete a voice at any time, which removes the samples and the derived model.

8. Generated output

As between you and us, you own the courses you generate and may use them personally or commercially, subject to these terms and to any rights held in the source material you supplied.

Two caveats worth stating plainly. Models can be confidently wrong, so verify anything that matters before relying on it. And similar prompts can produce similar output for different people, so we cannot promise that what you generate is unique or that you hold an exclusive right to it.

9. The public API

The Sun Public API is covered by these same terms. Tokens are personal to your account, must be kept secret, and can be revoked by you or by us. Usage is not metered or billed today; we may introduce quotas and will document them on the developers page before enforcing anything new.

10. Our intellectual property

The SUN software, interface, name, and logo belong to us. These terms grant you a limited, revocable, non-exclusive right to use the service, not a license to our brand or our code.

11. Termination

You can stop using SUN and delete your account whenever you like. We may suspend or close an account that violates these terms, creates legal risk, or has been inactive for a long period, and we will give notice where it is reasonable to do so. On termination your right to use the service ends and we delete your content as described in the privacy policy.

12. Disclaimers

SUN is provided "as is" and "as available". To the maximum extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that generated content will be accurate, that the service will be uninterrupted, or that every generation job will succeed.

13. Limitation of liability

To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the service is capped at the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Some jurisdictions do not allow these exclusions, in which case they apply to you only as far as the law permits.

14. Indemnity

You agree to indemnify us against claims arising from your use of the service, the material you submit, or your breach of these terms, including claims that a voice you cloned or a source you uploaded infringed someone's rights.

15. Changes

The service evolves, and features may be added, changed, or removed. We may also update these terms; when we do, we move the date at the top and give notice in the app for material changes. Continuing to use SUN after a change means you accept the revised terms.

16. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Delaware, and you and we consent to their jurisdiction.
